F) 4 Hour New York State Penal Code Article 35: Justification - $120.00 This course focuses on making logical decisions regarding the justification of the “Use of Force” under New York State Penal Code Article 35. Using force against another person(s) or threat represents the most severe intrusion possible on their respective liberty and person. Unjustified use of force, or excessive force, can have serious consequences, such as arrest and civil liabilities. Justification is a defense to an offense. A defense is a set of circumstances in which an individual admits to committing an offense while justifying their actions. However, failure to engage reasonable force can result in injury or death involving the victim and or innocent bystanders. Under New York State Article 35, the Penal Law provides justifications for actions pertaining to civilians and law enforcement officers. Despite the “policing powers” granted to law enforcement officers, they can be held to a higher level of accountability than their civilian counterparts. Furthermore, this course also addresses the potential consequences when an individual(s) is not justified to engage in “Use of Force” under Article 35.
